If you really want to know what all Tracy is about check out this article that was in the Indianapolis Star (Tracy’s hometown).
Exercise studios’ flop stirs lawsuit
Investor in East of L.A. business seeks an accounting from Fishers partner

A woman who hoped to fatten her exercise business in Fishers by adding a studio in Los Angeles now is being sued by her California partner.
In her June 7 complaint in Hamilton Superior Court, Deana Grabill claims Tracy Anderson misapplied funds and failed to pay taxes owed by their East of L.A. partnership.

Grabill, a former Fishers customer who helped open the California studio, seeks a financial accounting, compensation for losses and a liquidation of East of L.A., if anything is left.

According to Anderson, who rejects the claims of misconduct but has been embroiled in financial turmoil for years, East of L.A. was dissolved, and Grabill has no ties with either studio.

“I’m basically the talent, and she bought in with her MBA as the business partner, and she nearly ruined it,” said Anderson, who now operates here as Tracy Anderson Studios, 7266 Fishers Crossing Drive.

Grabill and Anderson formed their limited liability corporation in February 2005, with Grabill securing a line of credit to help cover the costs of operations, according to the lawsuit.

So far, Grabill says, she has contributed more than $100,000.

“It was my understanding (Anderson) had a studio up and operating and was just looking for some business savvy,” said Grabill’s attorney, Julianne Nixon, who agrees that her client was enlisted to help administer the business side of the partnership while Anderson developed its product line of studio and video exercise programs.

“That is what is supposed to have happened. That is not what actually happened.”

The lawsuit contends Grabill was quickly removed from day-to-day business affairs and that Anderson withheld her salary and information about financial matters that put Grabill at risk.

“Beginning in April 2005,” the lawsuit adds, “Anderson has paid personal expenses from East of L.A. funds without the consent of and directly contrary to the repeated requests of Grabill.

“Anderson continues to operate both the Indiana and California studios, has frozen Grabill out of East of L.A. and has usurped business opportunities of East of L.A. to herself.”

For Anderson, a Hamilton County native whose training in dance and drama set the stage for her business endeavors, the lawsuit is the latest in a string of financial difficulties.

Anderson, the wife of former Indiana University basketball standout Eric Anderson, opened her first Fishers venture in 2001 at 121st Street and Cumberland Road. The Andersons offered dance, drama and basketball instruction as Young Artists and Athletes Development Center.

By October 2002, according to court records, the operation had closed, with a history of deficient rent payments that were $25,000 past due.

Tracy Anderson then set up Performance TBA Dance and Hardcore Pilates in a strip mall south of 116th Street on Allisonville Road.

After running up a $25,000 rent deficit there she moved in 2004 to the small Fishers Crossing studio, where she dropped dance and pursued the exercise and weight loss programs that would become East of L.A.

But there was unfinished business. In early 2004, Duke Realty and Village Square Associates sued Anderson and her business entities. A year later, as East of L.A. was forming, judges awarded $450,000 to the landlords, and the Andersons filed bankruptcy to escape their debt.

Today, Tracy Anderson’s attorney in Muncie, John Brooke, said Grabill is right to think there is no money left in East of L.A.

“The limited liability corporation exists in name only,” said Brooke, who claimed the joint enterprise ended after the partners argued about cost overruns in L.A. and then separated.

“Deana’s not going to get any money out of it, and she may end up being partly responsible for some of the obligations.”

Among those obligations, Brooke said, are the tax claims.

ciao margherita..
